Justice files

By Senior Airman Shameka Scarborough 437th Airlift Wing, Legal Office

Four members of Charleston AFB received the following non-judicial punishments under Article 15 of the Uniform Code of Military Justice during December 2007.

The maximum punishment under Article 15 depends on the rank of the member being offered the Article 15 and the rank of the officer imposing punishment. If the commander finds that a military member committed the charged offense, the commander then determines the member's punishment based on the severity of the offense, the circumstances surrounding the offense, previous misconduct, and any matters in mitigation or extenuation presented by the member.

A 437th Aerial Port Squadron airman first class received an Article 15 for wrongful use of marijuana. The punishment consisted of reduction to the grade of Airman and a reprimand. The member was immediately discharged administratively with a general discharge characterization.

A 17th Airlift Squadron technical sergeant received an Article 15 for reckless driving. The punishment consisted of forfeitures of $300.00 pay per month for 2 months and a reprimand.

A 16th Airlift Squadron staff sergeant received an Article 15 for failing to obey a lawful order. The punishment consisted of reduction to the grade of Senior Airman (suspended), forfeiture of $300.00 pay per month for 2 months (suspended).

A 437th Aircraft Maintenance Squadron airman received an Article 15 for two counts of misusing his government travel card. The punishment consisted of reduction to the grade of airman basic (suspended), forfeiture of $200.00 pay, 14 days extra duty, and a reprimand.
