Two Airmen tried at Court Martial

One member of Charleston AFB was tried at a Special Court-Martial and another was tried at a General Court-Martial under the Uniform Code of Military Justice during February 2009. The maximum punishment at a Special Court-Martial consists of a bad-conduct discharge, 12 months confinement, forfeiture of two-thirds pay per month for 12 months, and a reduction in rank to airman basic. The maximum punishment at a General Court-Martial is the maximum amount set by law for each offense under the Uniform Code of Military Justice.

At the Special Court-Martial, a 437th Aerial Port Squadron senior airman was found guilty by a panel of officers for the following offense: simple assault with a BB gun, in violation of Article 128, UCMJ.

The senior airman was sentenced by the panel of officer members to three months of hard labor without confinement, two months restriction to Charleston AFB and a reduction in rank to airman.

At the General Court-Martial, a 437th Force Support Squadron Staff Sergeant was found guilty by military judge alone of the following offenses: assault consummated by a battery on four victims, in violation of Article 128, UCMJ; damage to non-military property of approximately $6,000, in violation of Article 109, UCMJ; fleeing apprehension by South Carolina law enforcement officials and resisting arrest, both in violation of Article 134, UCMJ.

The staff sergeant was sentenced by a panel of officers to three months of hard labor without confinement, 45 days restriction to Charleston AFB, forfeiture of $360 of pay and allowances per month for 17 months, and reduction in rank to senior airman.
