437 AW justice files; April

By Airman 1st Class Andrew Mackenroth 437th Airlift Wing Legal Office

Three members of Charleston AFB received the following non-judicial punishments under Article 15 of the Uniform Code of Military Justice in April:

A 437th Aircraft Maintenance Squadron staff sergeant received an Article 15 for possessing sexually explicit material while deployed, making a false official statement and downloading and distributing nude photographs of an NCO to Airmen. The punishment consisted of reduction in rank to senior airman, suspended forfeiture of $500 pay per month for two months, 45 days of extra duty and a reprimand.

A 437th Aerospace Medicine Squadron airman 1st class received an Article 15 for distributing Adderall, a Schedule II drug. The punishment consisted of reduction in rank to airman basic with reduction below rank of airman suspended, 60 days of restriction to the base and a reprimand.

A 437 AMXS airman 1st class received an Article 15 for being absent without leave less than three days, damaging government property and driving while intoxicated. The punishment consisted of reduction in rank to airman basic, forfeiture of $500 pay per month for two months, 45 days of extra duty and a reprimand.

The maximum punishment under Article 15 depends on the rank of the member being issued the Article 15 and the rank of the officer imposing punishment. If the commander finds a military member committed the charged offense, the commander then determines the member's punishment based on the severity of the offense, the circumstances surrounding the offense, previous misconduct and any matters in mitigation or extenuation presented by the member.
