CHARLESTON AIR FORCE BASE, S.C. –
Six Charleston Airmen were tried at the following courts-martial under the Uniform Code of Military Justice between May and October. Of the six, four were tried at special courts-martial and two were tried at summary courts-martial.
An airman first class from the 437th Force Support Squadron was found guilty at a special court-martial by a military judge for use of cocaine in violation of Article 112a of the UCMJ. The military judge sentenced the Airman to 75 days confinement, forfeiture of $600 pay per month for two months and reduction in rank to airman basic.
At a second special court-martial, an airman first class from the 437th Operations Support Squadron was found guilty by a military judge of the following offenses: willful dereliction by transporting an open container of alcohol in their personally owned vehicle in violation of Article 92 of the UCMJ and operating a motor vehicle while drunk in violation of Article 111 of the UCMJ. The Airman was stopped on base by security forces personnel and it was found the Airman's breath alcohol concentration was 0.33 percent. The Airman was sentenced to 105 days confinement, reduction in rank to airman basic, forfeiture of $850 pay per month for three months and two months of hard labor without confinement.
At a third special court-martial, an airman first class from the 437th Aircraft Maintenance Squadron was found guilty by a military judge of the following offenses: six specifications of absence without leave in violation of Article 86 of the UCMJ. The Airman was absent from the unit for a total of 21 days by implying he was serving honor guard duty and by implying to the honor guard he was at the unit. The Airman was sentenced by a military judge to 30 days of confinement, 45 days of hard labor without confinement and forfeiture of $1,239 pay per month for two months.
At a fourth special court-martial, an airman basic from the 437 FSS was found guilty by a military judge of the following offenses: disrespectful behavior towards a NCO in the execution of their duties in violation of Article 91 of the UCMJ, wrongful use of methamphetamine and wrongful use of marijuana in violation of Article 112a of the UCMJ, and unlawfully carrying of a concealed weapon in violation of Article 134 of the UCMJ. The Airman was sentenced to a bad conduct discharge, seven months confinement and forfeiture of $300 pay per month for seven months.
At the first summary court-martial, an airman first class from the 437 AMXS was found guilty by a summary court officer of the following offenses: two specifications of absence without leave, in violation of Article 86 of the UCMJ. The Airman was absent from their unit for a total of 46 days. The Airman claimed to have been ill and was unable to contact either the unit or the 437th Medical Group for medical attention. Investigation revealed the Airman's whereabouts included the dormitory, the dining facility and various downtown Charleston establishments. The summary court officer sentenced the Airman to hard labor without confinement for 45 days, restriction to the limits of Charleston AFB for 45 days and forfeiture of $933 pay for one month.
During the second summary court-martial, an airman first class from the 437th Aerial Port Squadron was found guilty of the following offenses: alcohol consumption while under the age of 21 in violation of Article 92 of the UCMJ, possession of more than one military-issued common access card, also in violation of Article 92 of the UCMJ and driving under the influence of alcohol in violation of Article 111 of the UCMJ. The summary court officer sentenced the Airman to 10 days of confinement, 20 days of hard labor without confinement, forfeiture of $500 pay per month for one month and restriction to the limits of Charleston AFB for 45 days.
